ISLAMABAD: The Islamabad High Court (IHC) declared the illegal arrest by the Police as an act of kidnapping.
IHC passed these remarks because the Police did not follow any kind of protocol or process during the arrest of a woman.
Justice Mohsin Akhtar Kiyani issued a written decision in the case against Muhammad Waqas, Aleem Sohail and his wife Sana Sohail. The court ruled that if there is tampering with justice, the proceedings will be null and void.
The court directed the Inspector General (IG) Islamabad to take action against the officials involved in the fake police encounter.
He further instructed the officials to fine each of the guilty Rs 100,000, and said that the Islamabad police officials will pay the fine amount to the plaintiff Sana Sohail as compensation.
Justice Mohsin Kiyani ordered the return of the owned vehicles, cash and jewellery taken from the woman’s house when arrested.
The Supreme Court has ruled that if the FIR is illegal, then the entire proceedings should be terminated. The court dismissed the police case against the plaintiffs.
