A major decision of the Federal Constitutional Court (FCC) has been issued to ensure the protection of women’s inheritance rights.
The court ruled that no regional tradition or family system can deprive women of their right to inheritance, and that denying women their inheritance rights is a violation of state law and the orders of Allah Almighty.
The Federal Constitutional Court, while declaring the decision of the Balochistan High Court null and void, stated that women’s right to inheritance is not merely a matter of state law but a divinely ordained right given by Allah Almighty.
The right to inheritance has been clearly established in the Holy Quran. Unfortunately, there is a prevailing tendency in society to deprive women of their rightful share in inheritance.
According to the court’s decision, women are often deprived of inheritance through social pressure and fraud. The court emphasised that it is the responsibility of the judiciary to carefully examine cases related to women’s inheritance rights.
The Federal Constitutional Court issued this ruling in the case of a woman from Balochistan, Bibi Amina, and ordered that the properties of the petitioner’s parents be presented before the civil court for determination of shares.
The court further directed that the civil court should decide the distribution of all properties in accordance with the Constitution and the law. Bibi Amina had challenged the denial of her share in the entire property by her brothers.
