FCC maintains authority of tax officials to raid without prior notice

The Federal Constitutional Court (FCC) has determined that tax authorities are permitted to carry out raids on business premises without prior notification, as stated in a judgement released on Thursday.

FCC Judge Justice Aamer Farooq, in a written decision regarding the extent of tax enforcement powers, stated that parliament has granted extensive authority to revenue officials to ensure the enforcement of tax laws.

The court dismissed the claim that a raid would be deemed unlawful in the absence of a formal case against a taxpayer.

It indicated that the judiciary cannot impose conditions on the law that parliament has not explicitly included.

The ruling indicated that tax officials are allowed to access premises at any time without prior notice, provided that the relevant commissioner documents in writing the specific legal provisions allegedly breached before sanctioning the action.

According to the judgment, authorities are fully authorised by FCC to confiscate computers, documents, and financial records during tax raids.

This decision enhances the legal foundation for unannounced inspections and maintains the enforcement capabilities of tax authorities in light of the government’s broader initiative to widen the tax base and combat evasion.

Govt seeks to broaden tax net after record collection

In January, the Finance Minister of Pakistan called on tax authorities to improve enforcement measures and include a greater number of individuals and businesses within the tax framework, following the country’s most significant revenue collection for the month of December.

According to an official statement, the Federal Board of Revenue (FBR) amassed Rs1,427.1 billion in December 2025.

This amount constituted 99 percent of its monthly target and marked the highest revenue collection ever recorded for December.

The Finance Minister characterised this accomplishment as promising, indicating that it demonstrated consistent progress over the previous year and a half.
