The Lahore High Court has issued a written decision on the petition of cricketer Babar Azam, declaring the decision to register a case against the cricketer null and void.
The High Court has accepted the petition filed by Babar Azam against the registration of the case.
In the petition, Babar Azam had challenged the order of the Justice of Peace to register the case.
The Justice of Peace had directed to register an FIR on the petition of a woman, Hamiza Mukhtar.
The woman had accused the petitioner Babar Azam of establishing relations by promising marriage.
Justice Asjad Javed Gharal of the Lahore High Court issued a written decision on Babar Azam’s petition, which consists of 8 pages. Barrister Haris Azmat appeared on behalf of the petitioner Babar Azam.
In the written decision, it was said that according to the woman, the two had a long-term relationship.
The woman took the position that the relationship lasted for about eight years. According to the woman, during this time, she also became pregnant in 2015.
The woman alleged that her pregnancy was later aborted. According to the woman, the petitioner also received a large amount of money from her.
According to the written decision, the woman’s position was that the petitioner later refused to marry, the Justice of the Peace had approved the woman’s request and ordered the registration of the case, the petitioner challenged the order of the Justice of the Peace in the Lahore High Court.
The court heard detailed arguments of the lawyers of the parties, also looked at the case record in detail, “the woman’s allegations are apparently not credible, remaining silent for eight years is an unusual situation.”
According to the written decision, “The allegation coming to light after such a long time is questionable, the mere claim of a promise of marriage does not justify the delay.”
“There is no such solid evidence on record, evidence was not presented to support the allegations”, the Justice of the Peace issued the order without proper investigation, the order of the Justice of the Peace to register the case was not in accordance with the law.
The Lahore High Court declared the order of the Justice of the Peace null and void.
