The federal government has decided to consider constitutional options, including the imposition of an emergency in Khyber Pakhtunkhwa (KP), amid growing security concerns and political tensions between the Centre and the Pakistan Tehreek-e-Insaf (PTI)-led provincial government.
The options under discussion include Article 232 of the Constitution of Pakistan, which deals with the proclamation of an emergency, and Article 234, which provides for action when the constitutional machinery of a province fails. Under Article 232, an emergency may be proclaimed under specified circumstances, including war, external aggression or internal disturbance beyond the control of a provincial government. Such a proclamation is subject to the constitutional requirements and procedures.
Article 234, meanwhile, addresses situations in which the President is satisfied that the provincial government cannot be carried on in accordance with the Constitution. Its invocation may lead to the exercise of certain provincial executive functions by the federal government or the President, subject to constitutional provisions.
If either provision is invoked, the powers and functioning of the provincial government could be significantly affected. However, the legal consequences would depend on the specific constitutional measure adopted and the applicable procedures.
A formal emergency proclamation may also have implications for certain fundamental rights and constitutional remedies, but any such restrictions would be governed by the Constitution and would not automatically apply in their entirety.
Security concerns and political tensions
The reported discussions come amid concerns over the security situation in Khyber Pakhtunkhwa and differences between the federal government and the provincial administration over counterterrorism measures.
Federal officials have reportedly raised questions about the provincial government’s cooperation and its response to security challenges. The issue has also become intertwined with broader political tensions between the federal coalition government and the PTI-led administration in KP.
The political friction has intensified amid disagreements over protest marches and demands concerning the release of PTI founder Imran Khan. However, any decision to impose an emergency or invoke Article 234 would require adherence to the relevant constitutional provisions and procedures. The reported consideration of these options does not, by itself, mean that either measure has been formally imposed.
Certain elements spreading fake news and propaganda
Meanwhile, certain elements are spreading fake news and propaganda regarding the situation in Khyber Pakhtunkhwa. Reports circulating on social media claim that preparations are underway to launch large-scale security operations in certain areas of the merged districts following the possible imposition of an emergency in the province.
These reports are entirely baseless and false. Intelligence-based operations (IBOs) are conducted on a daily basis in accordance with ground assessments and prevailing security threats. Such operations have been a routine practice in the past.
Claims regarding the launch of any new large-scale security operation are fabricated and misleading. Their apparent aim is to create unnecessary panic, spread unrest and cause anxiety among the local population.
