The United States Citizenship and Immigration Services (USCIS) will be updating two popular immigration forms. Applications submitted with the old version of the forms will be declined after the new forms are released.
The change impacts Form I-539 (Application to Extend/Change Nonimmigrant Status) and Form I-765 (Application for Employment Authorisation).
Both updated versions will have the date of the edition: 09/15/26.
The eligible nonimmigrants who wish to seek an extension or change of status in the US must file Form I-539.
It is also applicable to H-4 spouses and children of H-1B workers. The H-1B worker does not usually file the I-539; rather, the employer usually files the I-129.

If an applicant is eligible to apply for an Employment Authorisation Document (EAD), they can apply for Form I-765.
For certain H-4 spouses and other categories, as well as for F-1 international students applying for Optional Practical Training (OPT) or STEM OPT, the form is more critical.
The new I-539 will supersede the 08/28/24 version and the new I-765 will supersede the 08/21/25 version.
The current editions can be used by applicants if their application was postmarked or submitted electronically before September 15.
From that date, the new versions dated 09/15/26 will be accepted and there will be no grace period.
USCIS has provided previews of the revised forms and instructions, but cautioned applicants not to start filing the forms until September 15.
The revisions are linked to new immigration laws that establish set terms of admission for foreign media representatives with the I category, J-1 exchange visitors, and F-1 students.
With the new system, these groups may have to request an extension to stay longer than the prescribed time.
Avoid last-minute applications, as it is important for applicants to verify the form edition date to avoid form rejection.
