LHC says haq mehr is legal right, not a gift

The Lahore High Court has issued an important ruling on women’s rights and Haq Mehr today. The court said that Haq Mehr is a legal and religious right of the wife. It is not a gift from the husband.

The court also said it is a legal duty of the husband and is treated as a debt.

The Lahore High Court said that any agreement made at the time of marriage is legally valid. This includes written promises made outside the Nikah Nama.

The case was filed by a woman who asked the court to enforce an agreement. The agreement said she would receive a five marla house and maintenance during the iddat period. She said her husband signed this agreement on the wedding day, reports say.

The family court had already ruled in her favour. The husband then challenged the decision in the Lahore High Court. He said the agreement was not real and was made later.

After reviewing evidence and witness statements, the High Court rejected his appeal. It upheld the decision of the lower court. The court said witnesses confirmed the agreement was genuine, according to the reports.

The court also said that women often do not claim Haq Mehr at the time of marriage due to social pressure. It said this does not mean they give up their right.

The judgment said Haq Mehr can be agreed upon verbally or in writing. It can also be increased later with mutual consent. The court added that family courts must consider social conditions while making decisions.
