A petition has been filed in the Federal Constitutional Court (FCC) seeking the reinstatement of Ali Amin Gandapur as the Chief Minister of Khyber Pakhtunkhwa.
The petition was filed by renowned lawyer Sher Afzal Marwat, arguing that Ali Amin Gandapur’s resignation was unconstitutional and made under pressure; therefore, it should be declared null and void.
According to the petition, Sher Afzal Marwat requested the court to declare Ali Amin Gandapur’s resignation unconstitutional, null, and void.
The petition states that the de-notification of Ali Amin Gandapur was illegal and unconstitutional. It further alleges that his resignation was obtained under pressure and at the direction of a convicted and disqualified individual.
The petition also seeks to have the notification appointing Sohail Afridi as Chief Minister declared null and void. It requests the reinstatement of Ali Amin Gandapur as the Chief Minister of Khyber Pakhtunkhwa.
Additionally, the petition argues that Ali Amin Gandapur’s resignation holds no legal status and calls for all government decisions taken as a result of these allegedly unconstitutional measures to be annulled.
According to legal experts, such petitions usually raise important questions regarding constitutional interpretation and the legal procedure for resignation, which the court decides in light of the Constitution and the available evidence.
Political observers say that following this petition, further legal and political debate may emerge in the politics of Khyber Pakhtunkhwa, and the matter could take a more significant turn in the coming days.
