Govt orders transfer of IHC judges

Following a decision by the Judicial Commission of Pakistan, the Ministry of Law and Justice on Wednesday notified the transfer of three judges from the Islamabad High Court to other high courts under Article 200 of the Constitution.

The ministry said the President of Pakistan approved the transfers on the JCP’s recommendation.

According to the notification, Justice Mohsin Akhtar Kayani will move to the Lahore High Court, Justice Babar Sattar will join the Peshawar High Court, and Justice Saman Rafat Imtiaz will be transferred to the Sindh High Court.

The transfers came a day after the JCP approved the move in a meeting chaired by Chief Justice of Pakistan Yahya Afridi.

Several senior officials attended the meeting, including Justices Aminuddin Khan, Munib Akhtar, Aamer Farooq and Syed Hassan Azhar Rizvi, along with Law Minister Azam Nazir Tarar, Attorney General Mansoor Usman Awan, Pakistan Bar Council representative Ahsan Bhoon, Farooq H Naek, Ali Zafar and Gohar Ali Khan.

The commission also said that members withdrew proposals to transfer Justice Arbab M. Tahir to the Balochistan High Court and Justice Khadim Hussain Soomro to the Sindh High Court.

In addition, the JCP decided by majority that any vacancy created due to a judge’s transfer will be filled through another transfer. It said such vacancies will not be treated as new posts for fresh appointments.
