The Federal Constitutional Court on Monday set aside the Supreme Court’s decision ordering the demolition of Monal Restaurant in Islamabad’s Pir Sohawa area.
According to details, the court accepted appeals filed by the Capital Development Authority (CDA) and the Metropolitan Corporation Islamabad (MCI), while also vacating the stay order issued in the matter.
During the hearing headed by Justice Hassan Azhar Rizvi, the court ruled that disputes related to the ownership of Monal Restaurant would be decided by the relevant trial courts. It directed the lower courts to decide the cases independently and without being influenced by observations made in the earlier judgment.
The Federal Constitutional Court also instructed the trial courts to decide pending cases at the earliest, while matters related to administration and regulation would be handled by the relevant regulatory authorities.
During the proceedings, Justice Hassan Azhar Rizvi remarked that several important aspects had not been considered in the Supreme Court’s judgment. He also noted that the court had earlier expressed displeasure over the filing of the case and review petition, adding that the judgment contained matters that were not even part of the pleadings.
“We will not deliver an emotional verdict. The court will decide the matter strictly in accordance with the law after thoroughly examining the case,” Justice Rizvi observed.
Representing Monal Restaurant, lawyer Ahsan Bhoon argued that the court had examined the matter in great detail.
At this, Justice Rizvi remarked, “Do not praise the court here. We will issue an order based only on what has been heard during the proceedings, and the verdict will also be based on that.”
